Equinox distribution checks are being
prepared for USPS mailing to commence on February 19, 2008.
Please notice all issued checks will be
void after May 19, 2008.
The
total of the Settlement Fund is $16,584,160. There are 50,902 eligible claims
with valid mailing addresses that are approved for payment in the initial
distribution of the Settlement Fund. The total of these claims is
$277,394,776. The Settlement fund therefore has enough money to pay only 5.98%
of all approved claims.
Your
check is for 5.98% of your approved claim or at least $5.00. The check to each
of the other approved claimants with a valid mailing address is also for 5.98%
of the approved claim or at least $5.00. The U. S. District Court approved the
claim review process and approved the recommendations of the Receiver to
accept, revise, or decline the submitted claims. The amount of your approved
claim is final and the payment of the same percentage of claims to all approved
claimants with valid mailing addresses is final.
The
Receiver previously settled a tax claim and a legal fee claim for amounts much
less than demanded. As a result, your Settlement Fund was increased
substantially. You may visit the Equinox International website
(www.equinoxinternational.com) to read past reports and Court Orders. There is
no additional information.
The
email link on the web site will be available until 5/19/2008. Your distribution may be subject to Federal (and State/Local, if applicable) income tax
depending on your individual tax situation. Please consult your tax advisor.

Timely submitted and approved claims are
eligible for the following distribution plan as outlined in the Notice of Mandatory Class Settlement Agreement.

process has been completed and therefore your claim cannot be further reviewed
or changed.
